Virale srl processes the personal data you provide us when registering on our site https://www.virale-motorsport.com/home ("Site") and in the special sections of the same, on the occasion of events, fairs and events organized by Virale srl or in which Virale srl participates and during your interaction with Virale srl, including details of the purchases made.

With reference to the sales and interaction activities with Virale srl, the activities that take place in the stores and online activities are included, i.e. the management of your interaction with our websites and our internet and mobile applications (registration to websites / apps and online initiatives such as newsletters, mailing lists, events, competitions and promotions) and the provision, on request, of information / materials. a) Purposes for managing the relationship with customers

Virale srl processes your personal data to manage your registration and interaction with the site and to provide you with the requested products and services. Specifically, Virale srl processes your personal data for the following purposes: to allow registration and authenticated access to the Site; respond to your requests for information and / or materials; provide the products, services and assistance requested by you and the related after-sales services (e.g. guarantee), correctly execute obligations deriving from a contract with you or pre-contractual activities on your request (e.g. by contacting it following a request for a quote), also through the transmission of data by Virale srl to the sales network (so-called Dealer) or to third parties contractually linked to Virale srl.

Virale srl also processes your personal data to fulfill legal obligations and regulations relating to the activities indicated above and for the exercise of rights in court.

For these purposes, it is necessary to provide your personal data and any refusal would prevent Virale srl from carrying out the activities indicated above, for example responding to your requests for information, materials, providing you with the requested products and services.

With your consent, which is optional, Virale srl uses your personal data for marketing purposes, i.e. to send you promotional newsletters, commercial or advertising communications, for direct sales, product surveys aimed at detecting the degree of satisfaction of Customers and potential customers.

Marketing activities are carried out by e-mail (newsletter), telephone, sms, MMS, chat, banner on the Site,

instant messaging, social networks and traditional mail, including the sending of invitations to events in which Virale srl participates or organized by Virale srl, by the Virale srl sales and assistance network or by Virale srl's commercial Partners. These communications also include offers on products, services and initiatives of Virale srl's commercial partners.

With your consent, which is optional, Virale srl uses your personal data for profiling activities through the collection of information relating to your preferences, habits, lifestyle, information on your interaction with Virale srl and on the purchases made, for the creation of group and individual profiles ("profiling") and, if you have given your consent for marketing activities, also for sending communications and personalized promotional offers. The additional information used will be: information obtained by comparing the data collected by Virale srl with the data that are generally available to the public, for example the profiles of the social networks that you have made public; information collected through cookies and other tracking technologies on the Site (see our Cookie Policy, accessible from the home page of the Site (www.virale-motorsport.com/home); data collected through detection systems present on your motorcycle - where applicable and only in compliance with the Regulations. 2. Methods and legal bases of the treatment

Virale srl processes your personal data with and without the aid of electronic tools, on the basis of logic and procedures consistent with the purposes indicated below and in compliance with the Regulations, including confidentiality and security profiles.

The data can be provided by you when registering in our stores through paper and / or electronic forms, acquired during visits to our dealers and resellers, provided on the occasion of events, fairs and events in which Virale srl participates or organized by Virale srl, by members of the sales and assistance network of Virale srl or by the commercial Partners of Virale srl or provided during your interaction with the sites, internet and mobile applications of Virale srl.

In compliance with the Regulations, the personal data concerning you acquired from time to time are used to update and correct the information previously collected.

We process your personal data on the basis of your consent, a legitimate interest of Virale srl for carrying out commercial activities, obligations deriving from a contract between you and Virale srl or legal obligations.

However, you have the right to withdraw the consent given at any time, but this withdrawal does not affect the lawfulness of the processing that took place previously.

3. Recipients of your personal data

Personal data are accessible to duly authorized personnel based on criteria of necessity and are communicated to other external subjects in the following cases: (i) when the communication is required by applicable laws and regulations with respect to legitimate third parties who receive communications such as authorities and bodies public for their respective institutional purposes; (ii) communication necessary to perform a contract or pre-contractual activities activated by your request, e.g. communication of your data to one of our Dealers or commercial partners to allow it to provide you with the information, products or services you requested; (iii) communication to third parties in the event of extraordinary operations (e.g. mergers, acquisitions, sale of companies, etc.).

Your personal data is also shared with our service providers, e.g. for technical and organizational services that are functional to the purposes indicated above as independent collaborators, also in associated form, shipping company, marketing, payment management. We provide these subjects only with the data necessary to perform the agreed services and they act as Data Processors, based on the instructions received from Virale srl.

4. Transfers of personal data outside the European Union

Virale srl does not transfer the personal data of the interested parties collected through the www.virale-motorsport.com/ site and the tools provided therein in countries located outside the European Union or to international organizations.

5. Retention of personal data

Your personal data are kept by Virale srl for the time strictly necessary to pursue the purposes for which they are collected. Legal provisions impose obligations to keep documents for accounting and administrative purposes which, based on the ordinary limitation period of the contractual actions, we will cancel after the 10-year term has elapsed, starting from the moment of the termination of the contract.

The personal data processed for the "further purposes" listed above, will be kept for a maximum of 5 years for non-customers and 10 years for customers and ex-customers, a term deemed appropriate considering the frequency of purchase of our products, considered goods luxury.

Once the retention times have expired, personal data will be automatically deleted or anonymized.

Upon request to the Data Controller or to the Data Protection Officer, the interested party may receive detailed information on the retention times of personal data processed by Virale srl pursuant to the Regulation.

You can contact Virale srl as Data Controller or the Data Protection Officer at the addresses indicated above for the updated list of our data processors (i.e. our service providers), of the subjects to whom the data are communicated and to exercise the following rights pursuant to art. 15 ss. of the Regulations; access to your data to verify its existence or not and other information related to them, rectification, cancellation, request data portability, limitation of processing and lodge a complaint with the Control Authority (the Guarantor for Protection of Personal Data).

In addition, you may, at any time, object to the processing of your personal data processed for direct marketing purposes and, if requested by a particular situation, you may object to the processing of your personal data processed on the basis of Virale srl's legitimate interest in unless the existence of prevailing legitimate binding reasons of Virale srl to proceed with the processing (e.g. the exercise or defense of a right in court) is demonstrated.
